The Supreme Court on Tuesday (July 10) has decided to take hear the plea seeking interpretation of Article 239AA. The matter was mentioned before CJI bench.
The plea says that the communication between the Lieutenant Governor Anil Baijal and Delhi CM Arvind Kejriwal is not happening as per the judgement of the constitutional bench which had underlined that L-G had to act as per the aid and advise of the Council of Ministers of Delhi government except in matters of land, public order and police.
“The Lieutenant Governor should not act in a mechanical manner without due application of mind so as to refer every decision of the council of ministers to the President. The difference of opinion between the Lieutenant Governor and the Council of Ministers should have a sound rationale and there should not be exposition of the phenomenon of an obstructionist but reflection of the philosophy of affirmative constructionism and profound sagacity and judiciousness,” SC had said in the judgement.
