Amid the outbreak of pandemic COVID-19 the Supreme Court has taken suo moto cognizance of conditions of children of protection homes across country. The cognizance was taken up by a division bench comprising of Justice L. Nageshwara Rao & Justice Deepak Gupta.
The case is titled as ‘In re: Contagion of COVID-19 Virus In Child Protection Homes’ and shall be heard tomorrow by the bench. It has been witnessed that in these emergent situations the top court of the country is taking suo moto cognizance of matters which involve protection of life of citizen in challenging times.
Similarly, the question of spreading of corona virus came before the Supreme Court on which it took the suo moto cognizance and have constituted High Power Committees and Under Trial Release Committees and directed them to consider the case of release of convicts and under trial detainees to be released on bail and parole so as decongest the prisons across country.
The Supreme Court also took cognizance of provision of mid day meals to school children who are not able to come to school due to lockdown. The rising number of suo moto cases portrays that the Court is sympathetic to the cause and concern of common man in these challenging times and the same time it is being seen by many as rise of judicial activism or over arching of judiciary over the executive.
