The Supreme Court has refused to stay an order by the Allahabad High Court which allows appointment of a court commissioner for inspecting the premises of the Shahi-Idgah mosque.
The appointment of court commissioner was done in connection with the Krishna Janmabhoomi Shahi Idgah Masjid dispute.
The Senior Advocate Huzefa Ahmadi, mentioned the matter before the bench be of Justice Sanjiv Khanna and Justice SVN Bhatti who made a request to stay the High Court order passed yesterday.
The Top Court, refused to agree to the request and said that the matter shall be considered in January 2024.
The Allahabad High Court on Thursday granted its approval for the appointment of a Court Commissioner to conduct a survey of the Shahi Idgah Mosque, which is claimed to be the birthplace of Lord Krishna.
The order was passed by the single-judge Bench of Justice Mayank Kumar Jain on an Order 26 Rule 9 CPC application filed by the deity (Bhagwan Shri Krishna Virajman) and seven others through Advocates Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey and Devki Nandan.
The application was filed in an original suit pending in the High Court related to the Krishna Janmabhoomi-Shahi Idgah Mosque dispute of Mathura.
The application claimed that Lord Sri Krishna’s birthplace was beneath the mosque and that there were many signs which established that the mosque was a Hindu temple and the appointment of a commission was essential.
It further mentioned the existence of a lotus-shaped pillar, which was a classic characteristic of Hindu temples and an image of Sheshnaag, one of the Hindu deities who protected Lord Krishna on the night of his birth, which was also present there.
