Supreme Court apprised on apparent failure of Court’s registry for listing the case pertaining to Adani

The Supreme Court was apprised about the apparent failure of registry to list a case concerning Adani power 

The matter was mentioned before the bench comprising Justice Aniruddha Bose and Justice PV Sanjay Kumar by the Senior Advocate Dushyant Dave.

Advocate Dushyant Dave who appeared for Jaipur Vidyut Vitran Nigam Limited, expressed his concern over the registry’s failure to list the case against Adani Power, and called the situation sad.

He urged the Court to pass a judicial order and also emphasized that such delays do not happen in High Courts.

The Counsel added that an Assistant Registrar claimed that he was to have received instructions not to list the case.

The bench asked as to who was the person who directed the registry and at whose behest?

Advocate Dave said that he is not aware of the same but it ws disturbing. Court proposes, registry disposes. This in High Court, was impossible.

Dave further said that it is a contempt if government did it… But when Registry defies court orders, should it not viewed seriously?

He requested the lordship to pass a judicial order.

Dave requested the matter to be listed today itself because it was almost tooth and nail,

Justice Oka was compelled to issue notice to the Registry. It speaks very poorly on us the institution.. 

The Court however told Dushyant Dave that it will list the matter for hearing tomorrow (January 24, Wednesday) on top of the board as item number 1 after fresh matters.
