The Supreme Court granted bail on Friday to Nikhat Bano, wife of Suheldev Bharatiya Samaj Party (SBSP) MLA Abbas Ansari, who was arrested for allegedly visiting her husband unlawfully in jail.
After hearing both the parties and perusing the petition paper, the Bench of Justice A.S. Bopanna and Justice M.M. Sundresh granted bail to Bano on the grounds that she was a lactating mother to a one-year-old child.
Keeping in view the nature of the allegations against her, the Apex Court directed the petitioner to be released on bail subject to appropriate conditions imposed by the trial court.
Regarding the crime committed by Bano, daughter-in-law of gangster-turned-politician Mukhtar Ansari, the Bench observed that one of the conditions to visit a person in jail was to obtain appropriate orders from the trial court.
Bano was represented by Senior Advocate Kapil Sibal along with Advocate-on-Record Lzafeer Ahmad B.F.
Additional Solicitor General K.M. Natraj appeared for the state of Uttar Pradesh.
The Apex Court noted that it had refused interim bail to the petitioner on July 28 because it wanted to hear the arguments of the state government.
