The Supreme Court has recently granted bail to man after noting that the trial in his matter was yet to concluded and the man had been behind bars for over eight years as an undertrial in a murder case.
A bench comprising of Justice BR Gavai and Justice Vikram Nath added that the release on bail would be subject to conditions set by the trial court.
The bench said that taking into account that the petitioner has been imprisoned for about eight and a half years and that still the trial is not completed, we are inclined to grant him bail.
In January 2018, the Allahabad High Court had rejected the bail application of the petitioner for a second time which lead to the appeal before the top court.
The second bail application had been pending before the High Court for five years before it was disposed of.
The first information report (FIR) was filed in 2014, based on a complaint by the man’s aunt. He was booked for the offences of murder, and use of criminal force to outrage a woman’s modesty.
