The Supreme Court has stayed all action on FIRs registered in West Bengal against several senior BJP leaders. On Friday, the Apex Court issued notice to the Government of West Bengal on the petition of BJP National Vice President Mukul Roy, National General Secretary Kailash Vijayvargiya and MP Arjun Singh.
A bench headed by Justice Sanjay Kishan Kaul has stayed action until further orders. The Court has also sent notices to the Centre, CBI and others in this matter.
Arjun Singh’s counsel Advocate Mukul Rohatgi said 64 cases have been filed since he left the Trinamool Congress. Singh said in his petition, “I am an MP and cases were filed against me for inciting a riot, which is inspired by politics.”
At the same time, on behalf of Kailash Vijayvargiya, it was said, “I am an MP from Madhya Pradesh, I am a party officer, after I began going to West Bengal for campaigning, cases were filed against me.” Advocate Prashant Kumar, on behalf of Kailash Vijayvargiya, submitted that cases for minor offences have been registered so that he will not be able to travel in the state ahead of the Assembly polls due next year.
The bench also considered another petition filed by Kabir Shankar Bose, who said he was assaulted and attacked while travelling in Bengal. Senior Advocate Mahesh Jethmalani, appearing for Bose, submitted that his client was attacked despite having CISF(SSG) protection.
“I have been attacked and assaulted. I was attacked in the face of CISF(SSG) protection,” Jethmalani stated.
The bench, also comprising Justices Dinesh Maheshwari and Hrishikesh Roy, directed the CISF(SSG) to place before the court the special incident report in a sealed cover.
The BJP leaders had filed a petition in the Supreme Court demanding transfer of the case against them in West Bengal to an independent investigative agency and a hearing outside the state.
