The Supreme Court on Friday dismissed a public interest litigation (PIL), which challenged Darwin’s theory of biological evolution and Einstein’s mass energy equation.
The Bench of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia observed in the order that the petitioner wanted to prove that Darwinian theory of evolution and Einstein’s equation were wrong and he wanted a platform for the said purpose.
The Apex Court asked him the reason to file a writ petition under Article 32 of the Constitution, which dealt with the issues of fundamental rights. It further asked about the Counsel who filed the plea.
The Bench further sought to know about the violation of his fundamental right under Article 32, to which the petitioner-in-person asked as to where should he go?
The top court of the country replied that it did not have any advisory jurisdiction to tell him where he should go.
While noting that the petitioner was free to devise and propagate his own theory, the Court said that it would not ask the petitioner to prove whether Newton was wrong or Einstein was wrong.
At the commencement of hearing, the petitioner-in-person argued that whatever he studied during school and college time was wrong.
The Court then observed that whether the petitioner believed that the theories he learnt during the school time were wrong or right, the Supreme Court had nothing to do with it.
The Bench told the petitioner to devise his own theory and propagate the same, adding that the Court had no difficulty with the same.
The petitioner then said that 20 million people have died accepting Darwin’s theory, to which the top court of the country replied that these were not adjudicated rights.
The Apex Court then proceeded to dispose of the petition.
