Supreme Court dismisses plea seeking appointment of politically-neutral persons to higher Constitutional posts

The Supreme Court on Monday dismissed as withdrawn a petition seeking appointment of politically-neutral persons to higher Constitutional offices.


The Bench, led by Chief Justice of India Uday Umesh Lalit, sought the petitioner to show as to “how this case can be heard under Article 32?”

Appearing for the petitioner, Advocate S.N. Shukla mentioned a quote by the father of the Indian Constitution, Dr B.R. Ambedkar.

He alleged that the power of appointment to constitutional offices was based on political considerations.  

The Bench then observed that it was not inclined to entertain petitions like this.

After the Counsel agreed to withdraw the petition, the Apex Court disposed it off with the observation that though it was an idealistic and moral obligation of a son to take care of his father, but the Court could not compel every son to do so.
