Supreme Court expresses concerns over Central government’s response to Collegium recommendations

The Supreme Court has said that the way in which the Central government has been responding to the Supreme Court Collegium’s recommendations for appointment/ transfer of judges to High Courts and the Apex Court is a matter of great concern.

A bench of Justice Sanjay Kishan Kaul, Justice Manoj Misra and Justice Aravind Kumar said that the matters pertaining to appointment of judges appointments is in matter of concern.

A petition related to the delay by the Central government in approving names for elevation proposed by the Collegium was been heard by the bench today.

Justice Kaul said that he was concerned with some issues pertaining to the same.

The petitioner was represented by Prashant Bhushan who said that this attitude cannot go on endlessly as only some appointments are selectively notified..same are the transfers.

Justice Kaul underlined that the bench is equally concerned about the issue.

The Central government counsel asked for an adjournment due to the unavailability of the Attorney General.

The Court has now posted the case for the second week of March.

The Apex Court and the Central Government are on odds when it comes to the issue of delay in clearing names recommended by the Collegium.

In November, the Apex Court had rather requested the top-notch law officers of the Central government for ensuring that Supreme Court orders laid down for the appointment of judges to the Supreme Court and High Courts are followed.

In the last hearing the Apex court said that the Centre was not acting on the recommendations of Collegium.

The Court had called for a response from the Union Secretary of the Department of Justice, and the Additional Secretary of the Administration and Appointment Department, on the vaild reason on the same.

The Bench had said that the delay by the collegium recommendations has a long lasting affect on the seniority of judges
