Supreme Court issues notice in plea filed by Nigerian accused of duping a man of Rs 67 lakh

The Supreme Court today has issued notice in a plea filed by a Nigerian national accused of duping a man to the tune of Rs 66, 99,400 after enticing him to purchase “Akigbara Seeds” which is allegedly used as an ingredient in medicine for cancer treatment.

A three-judge bench of the Supreme Court, headed by Chief Justice N.V. Ramana, and comprising Justices Surya Kant & A.S. Bopanna, issued notice on the plea filed against the order of the Bombay High Court, which had dismissed his bail application and granted bail to another co-accused, Emeka Fever Eforchinachi, on certain terms and conditions who posed by name of Adity Sharma and operated the laptop, mobile phone and other electronic gadgets involved in commission of offence.

The allegations against Mike Kevin Philip are that he induced the complainant Khushal Tiwari to deposit a hefty amount in 9 different bank accounts. Before the accounts got frozen, Mike and other accused person withdrew the amount from the 100 bank accounts that he and other accused persons had opened. Mike Kevin, a Nigerian national, was charged for the offence under Section 420, 465, 468, 469, 471 IPC and Section 66(c) and 669(d) of IT Act.

Background

The background of the case is that one Usha Ferdinand approached complainant through Facebook and introduced herself as Marketing Assistant working for company based in London that manufactures medicines for cancer and AIDS and one of the ingredients is the seeds of Akigbara. It was informed to complainant that her company purchases seeds from a Japan-based concern. An offer was made by Usha Ferdinand to Khushal Tiwari that he would gain more profit if he purchases Akigbara seeds and sells them to her company and suggested to contact one Adity Sharma to procure seeds. Rs 66 lakh were paid in advance as consideration to various bank accounts as per instructions.

When complainant went to see Adity Sharma, he was untraceable. Thereafter complainant Khushal Tiwari realised that he had been duped.
