Justice BR Gavai of the Supreme Court expressed his concerns about the variability of views made by different benches of the Supreme Court.
The Justice stated this concern about the inconsistent views on the same subject by the different benches of the Supreme Court.
The Justice Gavai along with Justice Bela Trivedi held that indiscipline is prevalent amongst the Supreme Court lawyers and registry.
The Justice said that there are about 17 benches that function every day but hold different views on the same issue.
Talking about registry, they said it is better not to say anything..
The Justice said this while he was hearing a contempt petition initiated suo motu against a petitioner and his Advocate on Record for making derogatory remarks against the Karnataka High Court.
Senior Advocate Dushyant Dave informed that the AoR had tendered an unconditional apology in the matter.
The Bench said that it was a grave error on his part as the lawyer didn’t read anything and filed whatever came from Bangalore.
Dave said that his objective wasn’t to defend the advocate. The Court then suggested to move a discharge application in this regard while adding that it intended to send a message to the AoRs.
The Bench said that the Standard of Bar is worst, AoRs Acting as postman, filing whatever sent to them.
Dave agreed with the Bench, and said the AoR in question has been a part of the Bar for decades and such an incident had never occurred in the past.
The Court then ordered the Registry to take necessary steps to ensure that notice is served to the alleged contemnor number 1.
