A writ petition has been filed in the Supreme Court seeking a direction to the CBI and the Serious Fraud Investigation Office (SFIO) to probe some Chhattisgarh Government officials, bank officials and others in the alleged criminal conspiracy and mortgage of government leased land by forging documents.
The petition has been filed by Chhattisgarh Congress Secretary Amit Chandrekar, through Advocate-on-Record Ashwani Kumar Dubey, submitted that despite filing several representations to take action against the scammers, no action has been taken till date.
The matter will come up on Friday before the bench of Justices Navin Sinha and Krishna Murari.
“The petitioner filed a representation to the concerned authority to act in accordance with the law against the corruption in Chandulal Chandrakar Memorial Hospital Private Limited in collusion with Municipal Corporation (Nagar Palika Nigam), Bhilai, as it has not taken any steps against the management of M/s Chandulal Chandrakar Memorial Hospital Private Limited (CCMH), who have violated the terms of the lease. It is submitted that the concerned Authorities has not taken any action,” stated in the petition.
He has further submitted that the investigation is required because it is not a simple case of mischief forgery, criminal breach of trust, but the biggest scam of the state, committed by an organized money launderers, cheaters and fraudsters.
The petitioner has submitted that as per the terms of the lease deed, it was not allowed to mortgage the same to take a loan from a bank, however the alleged fraudsters in collision with each other succeeded in their evil design and took the loan and also siphoned off crores of rupees, the petition stated.
“that the fraudsters who are involved in the organized scam are not only playing with the life of people who are involved with the Hospital but also humiliated the respectful person of the State of Chhattisgarh Late Chandulal Chandrakarji. The Hospital Chandulal Chandrakar was started in the memory of late Chandulal Chandrakar in order to provide best medical facilities to the people of the area. However, later, the management started working for its own benefits and violated all the necessary norms including the terms of the lease and also siphoned off Crores of Rupees. The petitioner is the real grandson of elder brother of Late Chandulal Chandrakar and have filed number of representations / complaints before the Authorities seeking action against the fraudsters, however, the Authorities have not taken any action. The fraudsters only motive was to create wealth without bothering about the name and reputation to the Nobel Man (Gandhiji of Chhattisgarh (Late Chandulal Chandrakarji),” it said.
writ-petition-1.docxThe petitioner has contended that “the investigation is essential as the directors of the Respondent No. 6/ Chandulal Chnadrakar Memorial Hospital Pvt Ltd, is running a Medical College and Hospital in which the students took admission, as the respondent did not complied with the standards of Medical Council of India. Therefore, they didn’t get the affiliation for the fresh batch and the money deposited by the students has not been properly managed. He also came to know that the students who have deposited the money in the name of the tuition fees and the amount collected have been misappropriated.”
