The Supreme Court refused to intervene in the counselling for the National Eligibility cum Entrance Test (Postgraduate) 2022 on Monday, stating that it cannot “put the students in jeopardy”.
The oral observation was made by a Bench comprising Justice D.Y. Chandrachud and Justice Hima Kohli.
The matter was mentioned before the Apex Court by way of a writ petition, seeking urgent hearing before September 1.
The Petition challenged the decision of the National Board of Examinations in Medical Sciences (NBE) not to release the answer key and question paper for NEET-PG 2022.
The plea, filed by doctors who after completing their MBBS course had registered under the State Medical Council, contended that though there were serious discrepancies in their NEET-PG 2022 scores, NBE was not willing to grant them re-evaluation.
The petition prayed for directions to the examination board to release the question paper and answer key for NEET-PG 2022; provide options to the candidates to re-evaluate their papers; declare Clause 9.7 and 10.4 as unconstitutional; and permit candidates to challenge answer keys.
The petition further urged the Court to constitute a High Powered Committee to examine the instances of alleged discrepancies in scores and ensure fairness and transparency in the evaluation mechanism.
It also sought framing of guidelines for publishing question papers and answer keys after the examination.
The Doctors further sought direction to NBE to upload individual OMR answer sheets in login account, along with the question paper and the corresponding answer key, immediately after the examination, besides providing the answer key and question paper to the candidates for NEET-PG 2022, after they file an RTI application for the same.
Earlier on August 8, the top court of the country had refused to stay Counselling for the NEET-PG 2022, scheduled to start on September 1.
