The Supreme Court has given the go-ahead to the students of open schools recognized by the Central Board of Secondary Education (CBSE) and State Education Board to take up the National Eligibility-cum-Entrance Test (NEET) examination.
The Counsel appearing for the respondent apprised the Division Bench of Justice PS Narasimha and Justice Aravind Kumar of the letter dated November 2, 2023, addressed by the Under Graduate Medical Education Board of the National Medical Commission (NMC).
As per the letter, all open schools recognized by the Central Board of Secondary Education (CBSE) and State Education Board shall be considered for recognition by NMC for the purpose of NEET.
The Counsel further apprised the Apex Court about a public notice issued by the board on the same date, which said he National Medical Commission has framed the Graduate Medical Education Regulations, 2023. The same were notified on June 2, 2023.
As per Regulation 11(b) of GME Regulations 2023, candidates who have passed 10+2 or its equivalent with the subjects of Physics, Chemistry, Biology/Biotechnology & English shall be eligible for appearing in NEET-UG.
Therefore, after the framing of Graduate Medical Education Regulation, 2023 the earlier Regulations on Graduate Medical Education, 1997 including the various amendments stand repealed prospectively, added the public notice.
The Bench disposed of the appeal in view of the referred letter and the Public Notice, which allowed eligible students of open schools recognised by CBSE, State Education Boards to appear for the NEET-UG examination.
