The Supreme Court has asked the Patna High Court to decide afresh PIL that was filed against the fake pharmacists who are currently working in hospitals of Bihar.
A Bench comprising of Justice MR Shah and Justice MM Sundresh said that the priority of the citizens health should be kept in mind when such important issues come forth.
The Bench as also ordered the High a court for taking up the hearing within four weeks as this is matter of great importance.
The Bench observed and said that running a hospital in absence of a registered pharmacist or with help of fake pharmacist will ultimately result in poor health and wrong medicines given to the masses who believe on them and take medicines.
The Court said that under no circumstances can the State Government and the Bihar State Pharmacy Council cannot be permitted to play with the health and life of the citizen.
The present appeal was moved before the Apex Court by the applicant challenging a December 2019 order of a Division Bench of the Patna High Court that dismissed his PIL.
As per the petition filed many government hospitals in Bihar, do not have registered pharmacists who were selling medicines.
The PIL had requested the State government for not allowing the practices as it is in violation of the Pharmacy Act.
It also sought a direction to the concerned authorities to follow the Pharmacy Practice Regulations framed by the Pharmacy Council of India, for creation of dedicated pharmacist posts.
