The Supreme Court today refused to entertain petition seeking judicial probe into the alleged voice clips of Tamil Nadu Minister Palanivel Thiaga Rajan.
The minister had made remarks about accumalation of wealth by the TamilN adu Chief Minister MK Stalin and his family.
A bench comprising Chief Justice of India DY Chandrachud called the petition bogus, with strict instructions of not making Court into a “political platform”.
The CJI called the petition bogus stating that this was an audio clip in terms of which the former Finance Minister refers to the family of the CM and has no evidentiary value.
The petitioner Pranesh Rajamanickam, who appeared as party-in-person, said that Thiagarajan was changed as the Finance Minister due to the voice clips and if this wasnt his voice, why was he changed?
Justice JB Pardiwala and Justice Manoj Misra, said that the Court cannot go and investigate about the political decisions or change of portfolios.
The petitioner however laid emphasis on his entitlement as a citizen to know the reasons behind the decisions and contended that a judicial enquiry was need.
CJI Chandrachud questioned what actionable material petitioner had? He further asked if on the basis of some audio clip Article 32 petition can be investigated. Calling it a political issue and refusing to make Court a ground, the petition was dismissed.
Thh bench dictated the order of dismissal, but petitioner requested for directions to send the audio clips to the Central Forensic Science Laboratory.
This request was also rejected by the bench and the petition was dismissed.
