Supreme Court to hear Shahnawaz Hussain’s plea against registration of FIR in rape case next week

BJP leader Shahnawaz Hussain on Thursday moved the Supreme Court, challenging a Delhi High Court verdict, which ordered registration of FIR against him in a rape case of 2018.

The Apex Court agreed to list the petition next week.

On Wednesday, the Delhi High Court had flayed Delhi Police for not registering an FIR against BJP leader Shahnawaz Hussain on charges of rape, and directed it complete the investigation after registration of FIR within three months.

The Single-Judge Bench of Justice Asha Menon on Wednesday questioned the working style of Delhi Police and said that the complaint sent by the survivor to the Commissioner of Police in 2018 clearly disclosed the commission of cognisable offence of rape “after administration of a stupefying substance”.

On the order of the lower court, the complaint was forwarded to the Station House Officer, who was obligated under law to register the FIR, but he did not do so, noted the Court.

It said police did not file the final report in the lower court. Police had submitted an initial report in the lower court, stating that the case against Hussain was not made out, observed the Single Bench.

In January 2018, a Delhi-based woman had accused Hussain of raping her at a Chhattarpur Farm House and also threatening to kill her.

The woman had alleged that in April, Shahnawaz called her to a farmhouse and raped her there, after lacing her cold drink with a sedative.
