Supreme Court says UP govt should implement Right to Education Act in letter and spirit

The Supreme Court has slammed the Uttar Pradesh government for its dealing with the incident where a school teacher was seen provoking students to slap their muslim classmate.

A bench comprising of Justice Abhay S Oka and Justice Ujjal Bhuyan gave directions to the UP Government State for providing counselling to all the children who were made perpetrators of the offence as was directed to them.

Justice Oka said that state government should see the affidavit as there has been complete breach of the directions by court.

Justice Oka remarked that not a single kid was given counselling! The Court had even given names of organisations. This has to be done in letter and spirit.

The bench noted in its order that after going through the latest TISS report which calls for counselling of all the students who had taken part in corporal punishment as participants and witnesses. Nothing has been done by the State, it is too late in the day. We direct the State to immediately implement the directions specially for the witness children.

The State government was directed to file a compliance affidavit by February 28 and the case will be heard again on March 1.

A plea by Tushar Gandhi was been heard in the Supreme Court seeking action against school teacher Tripta Tyagi for allegedly goading students to slap a Muslim sudent.

It is very important to note that the teacher Tyagi allegedly made derogatory remarks about the Muslim student’s religion and instigated classmates to beat him in a viral video.

The school in Khubbapur village was sealed afterward.
