Supreme Court Warns Prolific PIL Lawyer Of Ban

The Supreme Court on Monday warned an advocate Ashwini Upadhyay that it would have to considering banning him from filing PIL’s s he was wantonly misusing it. Chief Justice Ranjan Gogoi and Justice S K Kaul  said this while dismissing a PIL seeking a limit on donations to political parties.

Upadhyay had prayed that relevant sections of the Income Tax Act be given only to those political parties which contest and win elections to Parliament and assemblies. The leader also prayed that the ECI be directed to de-register the political parties, which do not contest elections or accept a donation in cash of more than Rs. 2,000 per person per year; or accept a total donation of either more than Rs. 10 crore or 10% of the total donation in cash, whichever is less.
