Supreme Court warns of summary dismissal of cases at final disposal stage if counsel fails to submit short synopsis

The Supreme Court has said that if counsel did not file a three-page synopsis of their submissions, then the Courtroom 2 will see summary dismissal of cases at the stage of final disposal or final hearing.

The Bench of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia have included a sentence on each page of the causelist, which said that the parties should be ready with a short synopsis of not more than three pages each in the final hearing/disposal matters. Appeals will be summarily dismissed if this direction is not followed, it added.

This is not the first time in the case of Justice Kaul as on several occasions earlier, he has criticised the counsel for not filing short three-page synopsis, even after instructions to this effect were clearly mentioned in the causelists of his court.

Justice Kaul recently hauled a counsel who had not filed a synopsis and said that this type of casual attitude will not work. He added that now there will be summary (dismissal) proceedings.

Recently on September 5, another advocate was taken to task by the Supreme Court judge. He questioned if the counsel whether he knew the process right and refused to go through the memo.

As per the latest judgement by Supreme Court, the quality of synopses is among the considerations for designation of a senior counsel.
