Top Court refuses urgent listing of plea by wife of murdered gangster Sanjiv Jeeva

The Apex Court on Friday has refused Payal Maheshwari, wife of deceased gangster Sanjiv Maheshwari Jeeva, who was shot dead on the premises of a Lucknow court on June 7 for an urgent listing of her plea.

A vacation bench consisting of Justice Aniruddha Bose and Justice Rajesh Bindal were of the view that the petitioner was constantly changing her stand.

While she initially sought permission to attend the funeral, the UP government added that she now seeks interim protection from coercive action by the police since she is a history sheeter too.

The Court, therefore, said that there is no urgency in the matter and posted it for hearing after the summer vacation.

The Court was hearing a plea Payal Maheshwari seeking permission to attend her husband’s funeral.

During the hearing of the mater today, Uttar Pradesh Additional Advocate General (AAG) Garima Prashad told the Court that the State had given permission to Maheshwari to attend the funeral but she did not.

“The one seeking permission is also a history sheeter. We know how it works. We had already given permission to attend but she did not attend,” the AAG said.

The counsel for the wife then said,

“I wanted a no coercive step order, not the funeral but the last rites as per Hindu customs.”

Justice Bose then remarked,

“The stand is continuously shifting. Matter to be listed after vacations. No urgency for vacation hearing.”

Jeeva was shot dead on the premises of a Lucknow court on Wednesday, June 7. Reportedly a close associate of former UP MLA Mukhtar Ansari, Jeeva was an accused in the murder of senior Bharatiya Janata Party (BJP) leader Brahm Dutt Dwivedi.
