The Bengal BJP told Supreme Court on Tuesday that it is ready to reschedule the rath yatra in the state and sought West Bengal government’s reply on that.
The bench comprising Justices L Nageswara Rao and S K Kaul accordingly adjourned the matter to January 15.
The apex court was acting on the plea Bengal BJP against the Calcutta High Court order stopping BJP’s yatra in West Bengal.
The Bengal BJP had moved the apex court challenging the Division Bench order reversing a single bench’s tentative assent to the party’s ‘Rath Yatra‘ programme renamed as ‘save democracy rallies’ in Bengal. It had mentioned the matter for urgent hearing but the Supreme Court had denied it saying that it would hear the matter after Winter vacations.
In its plea before the Supreme Court, the BJP has challenged the Calcutta High Court order objecting that the fundamental right of the petitioner to organize a nonviolent yatra cannot be refused on the ground of mere hypothesis and speculations.
