West Bengal post-poll violence: Supreme Court issues notice on plea seeking SIT probe

The petition alleged that the Government, Officers, Officials, the Administration, and the Police are supporting workers of TMC, due to which the life, liberty, prestige, dignity, and modesty of women are being taken away as is evident from the fact that a number of persons have been harmed, butchered, mercilessly Murdered, and the Girls and women have been raped and no steps have been taken for their safety.

The Supreme Court has today issued a notice in a plea seeking directions for an SIT investigation into alleged post-poll violence in West Bengal by workers of Trinamool Congress (TMC) against Hindus for supporting the BJP in the Assembly Elections 2021.

A bench of Justices Vineet Saran and Dinesh Maheshwari has sought the response of the Union of India, the state of West Bengal, and the Election Commission of India and asked them to file their replies. The petition before the Apex Court has been filed by Ranjana Agnihotri through AOR Vishnu Shankar Jain alleging that soon after the declaration of legislative assembly results on May 2, 2021, the TMC workers and supporters started creating chaos, unrest and set the houses and properties of Hindus on fire, looted and plundered their belongings for the simple reason that they had supported BJP in Assembly Elections.

It further alleged that the Government and administration remained a silent spectators and no protection was provided to the victims by them. The Government, Officers, Officials, the Administration, and the Police are supporting workers of TMC, due to which the life, liberty, prestige, dignity, and modesty of women are being taken away as is evident from the fact that a number of persons have been harmed, butchered, mercilessly Murdered, and the Girls and women have been raped and no steps have been taken for their safety. No appropriate action has been taken against the culprits, due to which the life, liberty, dignity of the women & children are in peril and the future of Hindu residents in the state is in jeopardy. 

The petitioner has also made West Bengal Chief Minister Mamata Banerjee a party respondent but the court hasn’t issued any notice to her. 

The petitioner has alleged that TMC party contested the election purely on a communal basis arousing the feelings of Muslims and appealing to them to remain united and vote for their party for their future. 

“It is a fact that the Muslim population is about 30% in West Bengal. The reason is the illegal Bangladeshi migrants and Rohingya Muslims have been registered as voters without making any proper scrutiny and inquiry. In about 100 constituencies Muslim voters decide the fate of the candidate. For the lust of power political parties allure & appease Muslims to get their votes even at the cost of the future of the country,” said the plea. 

Furthermore the plea has alleged that a section of Muslims is humiliating Hindus after the Victory of TMC in the Elections. 

The plea has sought the following prayers; 

1- to direct the Central Government and the State Government to award compensation to the victim and their family members after ascertaining the nature of loss sustained by them in post poll violence committed from 2.05.2021. 

2- to direct the Central Government and the State Government to take steps for rehabilitation of the persons who have migrated to Assam or any other place in India due to violence erupted since 2.05.2021. 

3- to direct the Central Government and the State Government to take appropriate steps to protect the life, liberty, dignity of Hindus as guaranteed under Article 14, 21, and 25 of the Constitution of India and reflected in solemn declaration made in the preamble of the Constitution.

4- to direct the Central Government to exercise its powers conferred by Article 355 & 365 keeping in view the deteriorating condition posing a threat to sovereignty and integrity of India. 

5- to direct the Central Government to deploy armed forces/paramilitary forces in the aid of the Administrative Authorities to bring normalcy in the State and to save the State from internal Disturbance.
