The Bombay High Court today adjourned the bail plea of Malegaon bomb blast accused Lt Col Prasad Purohit to March 15.
Lt Col Purohit’s lawyer argued before the division bench of Justices Ranjit More and V L Achaliya that even though the accused has been languishing in jail for the past eight years in the name of investigation, no charges have been made against him.
She further argued that even the chargesheet didn’t specify the offence committed by him. She also pointed out that the Supreme Court while hearing his previous bail plea, had observed that this case doesn’t attract Maharashtra Control of Organised Crime Act (MCOCA) under which he was arrested and jailed.
The National Investigation Agency(NIA) opposed the bail plea by filing a reply through its counsel.
In October last year, Lt Col Purohit, and three other accused in the 2008 bomb blast case were denied bail by a special MCOCA court for their alleged extremism towards creating a ‘Hindu Rashtra’, and their animosity towards minorities.
