In a major legal reform concerning Indian armed forces, Defense Minister Manohar Parrikar has issued instructions to stop litigation against military personnel, which includes both serving and retired personnels.
Taking a strong view of the continuous litigations against military personnel, who file case against the establishment due to various public/military policies (most of them involving compensations), the Minister has instructed all concerned officials to reduce the number ‘frivolous complaints’.
As per the new policy, Defense Ministry will file no legal case unless the matter has been approved by the Minister himself.
Parrikar had constituted a committee to investigate rising cases of litigation, and reportedly, the committee had expressed displeasure over the style of functioning of the Ministry, chiding them to be ‘indulging in litigation of luxury’.
The report said, “Litigation is often caused by an ego-fuelled approach of the establishment which views a Complainant/Applicant/Litigant as someone who has challenged the system. State should not litigate against its own citizens based on prestige or by invoking a hook or crook approach and should rather try to resolve issues.”
