This matter is an “Accident in medical education”, according to Justice Mishra, Supreme Court

The case of Soumya Rajan Panda Vs Subhalaxmi Dash, before Justice Dipak Misra and Justice Shiva Kirti Singh, regarding transfer of 123 students of Sardar Rajas Medical College.

As per the earlier order Court directed that three colleges shall accommodate total of 41 students each. The trust running the closed medical college was found liable and was asked to compensate the students since the students moved from “a sphere of certainty to the domain of uncertainty “.

Court was informed today that the liability of the Selwam Educational  trust has not been decided yet.  Court said that Dispute going on between MCI and the trust will be decided in a different petition under article 32. The Court stated that the students should not suffer due to the fight between the MCI and the Trust. Further, MCI stated that the degrees of the transferred students will be recognized.

The trust has been directed to deposit RS. 2 crore in the Supreme Court registry within 2 weeks which would be held in Fixed Deposit. The three colleges are commanded to treat the transferred students at par with other students in matters of using library, sitting and education etc. State of Odisha to confirm the implementation of the court’s order and submit a report in 2 weeks. Next hearing listed on 9th May.
