The Delhi High Court on Tuesday heard Senior Advocate Mohit Mathur appearing for the petitioner in length and has asked Mathur to submit a list of judgments referred by him during the hearing of a plea seeking directions for the e-registration of wills.
Hearing the plea through video conferencing, Chief Justice D.N. Patel and Justice Jyoti Singh noted arguments made by Mathur stating traders are conducting online trading.
The petition has been filed by advocate Gaurav Gambhir, who has highlighted the ambiguity among several sub-registrar offices in Delhi over acceptance of documents executed by senior citizens and other vulnerable persons due to advisory for limited movement of such persons.
Mathur, referring to several judgments, submitted,
“Quashing of FIRs are being allowed by our own Courts through video conferencing in connection to the law appearing personally doesn’t mean physical presence.”
However, the Counsel appearing for the Respondent submitted that “The judgments referred by Mathur doesn’t include the concept of fraud. There are a plethora of property fraud cases, physical presence is required in such cases.”
However, Mathur contended, “It is nothing but only an adamance on the part of the government.”
The bench has asked Mathur to submit the list of judgments referred by him and has listed the matter for February 19.
