Petition in High Court alleges “non-application” of mind while granting the environment clearance for Nauroji Nagar redevelopment project

A bench of Justice G S Sistani and Justice Jyoti Singh, while hearing a plea  by one Kaushal Kant Mishra, asked the National Building Construction Corporation to satisfy the court on environment impact assessment (EIA) report for the Nauroji Nagar redevelopment project after the Court was informed by the petitioner, of it  being copied from that of a project in Tamil Nadu.

Mishra, had challenged the Nauroji Nagar redevelopment project in terms of environment clearance given, terming it as vague-  “non-application of mind while granting the environmental clearance”

The council for the petitioner further argued that the report suggests of AIIMS being 9.5 km away from the site, however, the statement is absolutely incorrect. The map jurisdiction of the area was thus presented in front of the bench.

Mishra told the court that the report is based on domestic usage while they are building “World Trade Center” out there, which needless to say is purely a commercial entity.

“ Commercial buildings in the residential area will lead to more traffic and water wastage. Why cant the same model of that of Khan Market could be followed- where residential houses and shops are in the same building” the bench argued while asking for a revaluation of all the clearances
