Aadhaar linkages case: Subramanium says this infringes on fundamental rights

The hearings on Aadhaar and its various linkages and privacy and security issued attached to them continued before the Supreme Court constitution bench of Chief Justice Dipak Misra and Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan on Tuesday (February 20).

The day’s proceedings were very short, what with Justice Chandrachud not sitting after the break (hence no constitution bench sitting).

Senior advocate Gopal Subramanium continued his submission in the first session, saying: “Existence of Right to Privacy is in alienable and Aadhaar is an invasion into one’s fundamental rights.”

He said: “Ultimately, this court has to decide if the issue is constitutionally valid.”

Thereafter he read out the landmark judgments relating to right to privacy.

The court adjourned and the mater comes up again on Wednesday (February 21).
