NOTA in Rajya Sabha elections: It is a matter of choice, EC tells SC

Shailesh Manubhai Parmar had moved the Supreme Court, challenging the applicability of NOTA in Rajya Sabha elections. The petitioner had submitted that it should not be applied in the Rajya Sabha elections.

On Thursday (May 17) Chief Justice Dipak Misra commented that the votes (in Rajya Sabha elections) are computed in a different manner.

The petitioner said: “If NOTA is applicable, how will the reconciliation with the 10th schedule of supporting the party apply, which is negated by the judgment in the Kuldip Nayar case.”

The counsel for respondent Election Commission of India (EC) said that nothing on record has shown how will it prejudice the entire voting. NOTA is a matter of right of choice.

The matter has been listed for July 30.
