NRI admission to minority college: SC refers case back to high court

The Supreme Court vacation bench of Justice S Abdul Nazeer and Indu Malhotra on Wednesday (June 20) referred a case of NRI admissions to the Christian Medical College Ludhiana Society back to the Punjab and Haryana high Court for appeal.

The case is of a writ petition relating to admission in NRI quota which has been implemented by way of notification published by the state of Punjab. This notification has been challenged by the college since it is a minority non-aided institution.

On Wednesday senior counsel Meenakshi Arora appeared for the college and said that the institution is functioning since 1881 and it began its own admission procedure from 1952. She preferred the judgment of TM Pai foundation, Inamdar, etc. She further referred to an order of December 2, 2010 where it was said that this institution can go on with its own admission procedure.

The bench said that since the matter is related with the notification published by the state, the high court will be the first instance court. The bench asked the counsel to go before the high court and passed an order asking the high court to take up the matter expeditiously since the online admission will close on June 23, 2018.
