SC bench order on Judge Loya hearing says “Put up before appropriate bench”

The entire issue of dealings and the case involving CBI Judge B H Loya has become engulfed in a mist. On Tuesday the Supreme Court bench of Justices Arun Mishra and Mohan M Shantanagoudar handled the issue in which the bench was given the investigation report on the unusual death of CBI Judge B H Loya by the Maharashtra government in a sealed envelope.

In court Justice Mishra made some observations regarding what was the secret part of the report and why it should remain secret. The judge also made a comment that the petitioners should be allowed to see the secret portion, though marked separately as “secret”.

The order (see below) that came out later, though, said a somewhat different story.

The three-line order said: “Let the documents be placed on record within seven days and if it is considered appropriate copies be furnished to the petitioners.”

Then, in the next line, the order also says: “Put up before the appropriate Bench.”

It is not clear if Justice Mishra wants to opt out of this case which was one of the main reasons precipitating the unprecedented press conference that four senior Supreme Court judges held. It has been learnt that Justice Mishra has not been happy with the developments that involves him indirectly.
