SC: Official accommodation can’t be retained on compassionate grounds as compared to compassionate appointment

The apex court on Thursday (June 21) noted that doctrine of compassionate appointment can’t be applied when it comes to retaining official accommodation on compassionate grounds.

A vacation bench of Justices A Abdul Nazeer and Indu Malhotra made the remark on the special leave petition (SLP) filed by Kamlesh Ahlawat who had approached the court seeking extension of time for holding official accommodation. The petitioner had already been living in the official accommodation (which was allotted to his father and died five years ago) for five years and further sought more time to continue living in the official accommodation.

The bench said that there can be no further extension of time, while disposing of the SLP and gave three months time to Ahlawat to vacate the accommodation.
