Supreme Court directs transfer of trial in case of 8-year-old Bakerwal girl who was abducted, raped and later found murdered in Kathua in Jammu & Kashmir, rules out CBI probe

The Supreme Court, on Monday (May 7), ordered the transfer of trial from Kathua in Jammu and Kashmir to Pathankot in Punjab in the case of the 8-year-old Bakerwal (shepherd) girl who had been abducted, gang-raped and then found murdered in Kathua last month.

Senior advocate Indira Jaising had urged the top court to transfer the trial in the case out of Kathua, informing the court that there was a high risk of the investigation being compromised and the family of the victim being subjected to intimidation.

The bench of Chief Justice Dipak Misra and Justices DY Chandrachud and Indu Malhotra, on Monday, ordered that to ensure a fair trial of the highly sensitive case, the trial must be transferred to Pathankot in Punjab. However, the court ruled out the possibility of transferring the investigation in the case from the Jammu & Kashmir police to the CBI.
