Supreme Court allows those who have cleared B.Ed to apply for shiksha mitra in UP

The Supreme Court today directed all those who have cleared their B.Ed to apply for the post of Shiksha Mitra in Uttar Pradesh.

The bench of Justices Deepak Mishra and Shiva Kirti Singh also directed the state government to submit a report stating the criteria for appointment.

The court also admitted interim applications, and directed the state counsel Gaurav Bhatia to compile a list of candidates.

The next date of hearing is May 9.

On 7th December, 2015, the Allahabad High Court had passed an order against Shiksha Mitra and the policy of UP government, saying that Shiksha Mitra Samayojan is illegal and they can’t be appointed on the posts of assistant teacher. The court also said the decision of Shiksha Mitra is unconstitutional.

The court also clarified that the state government has no legal right over giving relaxation in appointment of teacher instead it’s a right of NCTE.

The High Court observed that training of Shiksha Mitra through distance education is also an illegal way of Teacher Training. So amendment of teacher service rule which was done for Shiksha Mitra is now ineffective.
