SC asks Unitech to deposit Rs 3 crore more Dec. 11

Home-buyers from Unitech had approached the court for possession of flats they had paid for, or for refund of money they had already paid to the builders.

The builders owe the home owners a principal amount of Rs 22 crore, of which they had deposited only Rs 8 crore.

The Supreme Court bench of Justices Dipak Misra, AM Khanwilkar and DY Chandrachud on Friday (October 27) directed real estate major Unitech to deposit another Rs 3 crore by December 11.

The bench listed the next hearing of the case to December 14.

The bench was hearing the plea by the flat buyers of the project “Exquisite” in Nirvana Country-2, Gurgaon. The flat buyers have sought compensation from Unitech for not delivering the flats on time. While 38 flat buyers wanted possession of flat and 29 wanted refund of their money.

The sale consideration in all the cases was agreed at more than Rs 1 crore and allotment letters were issued, allotting different flats to the complainants, for the said agreed consideration. The allotment was followed by Buyers Agreements executed between the parties. As per clause 4(a) of the Buyers Agreement, the possession was proposed to be delivered within a period of 36 months from the date of the said agreement. Which was not delivered hence buyers approached NCDRC.
