Take back order on SC/ST Act, Union Govt appeals at SC

592
Supreme Court

The Union government has presented an appeal to the Supreme Court, demanding the immediate withdrawal of order on the stay on arrests in the SC /ST Act.

The appeal has said that the court cannot make such changes in the law. It says that Parliament has the right to make laws.

It also says that a police officer’s work is to write FIRs in the case of a cognizable offence. It says that the Supreme Court itself had passed such an order in the case of Lalita Kumari. Now the new order which says that an FIR can be lodged in the SC/ST after an investigation by the DSP is wrong.

The appeal said that this order weakens the act.

It said that the court’s order has caused damage to society and that was why this order should be taken back.
