ILNS: The Supreme Court bench of Chief Justice S.A. Bobde and Justices A.S. Bopanna and V. Ramasubramanian on Tuesday will hear a plea challenging the order of the Kerala High Court in which the high court dismissed a plea seeking direction to quash the 11th Pay Commission recommendation to increase the salaries of government employees and pensions of retired state government employees on the ground of total violation of the recommendation made by the 10th Pay Commission.
The petitioner has sought for a mandamus directing respondents to reconsider implementation of the 11th Pay Commission. The petitioner has also sought for a mandamus directing the state of Kerala, represented by Chief Secretary, Principal Secretary, Department of Finance, and Principal Secretary, Department of General Administration/respondents 1 to 3 respectively, to increase the pension of agricultural labourers, age old pension etc, in parity with the pension of its employees covered under the 11th Pay Commission.

The Kerala High Court, while dismissing the plea, had noted “When the petitioner seeks to quash the 11th Pay Commission recommendation to increase the salary of Government employees and pension of the retired employees of the State, quite contrary to the same, petitioner has sought for implementation of 11th Pay Commission, in so far as to increase in the pension of agricultural labourers, age old pension etc.”
