Allahabad HC Slaps Show-cause Notice on Special CBI Judge

The Allahabad High Court has issued a show-cause notice on Anil Kumar Jha, special judge of the CBI court in Ghaziabad, asking for an explanation as to why, despite having granted bail to Ms Kavita why was she not released from custody for a month.

The high court’s charge is directly on the CBI special judge.

The court has asked the district magistrate of Ghaziabad to investigate the case and report back within six weeks. The hearing will take place on July 18.

The Allahabad High Court order was issued by the bench of Justices Tarun Agarwala and Rajul Bhargava on a PIL by Kavita.

The court has also asked an explanation from the CBI court on the PIL.

The high court has asked special CBI judge Jha as to why Kavita was kept in custody despite the bail, without any cause. The court also asked Jha to show cause as to “why no departmental action should be taken against her” and why the amount due to the appellant as compensation “should not be deducted from her salary?”

The allegation against Kavita and co-accused VN Mathur is of criminal conspiracy and fraud. The allegations were made by the CBI, who had submitted a chargesheet. Both accused got bail. Even before the trial was complete the CBI submitted a supplementary chargesheet and the accused were taken into custody on April 13. On April 20, they were asked for personal bonds of Rs 1 lakh and two sureties. Mathur, was released on his bond with Kavita being kept in custody.
