Allahabad High Court expresses dissatisfaction on working style of lawyers

The Allahabad High Court has expressed dissatisfaction over the working style and functioning of some lawyers empanelled by the government, saying that the court is constantly facing situations where judicial work is being obstructed due to such Advocates.

A Single Bench of Justice Manju Rani Chauhan passed this order while hearing a Criminal Misc Bail Application filed by Satish Kumar.

M.C Chaturvedi, Additional Advocate General is present before the Court along with Government Advocate S.K Pal and Principal Secretary (L.R) and tendering unconditional apology and request for one opportunity to look into the working system of panel lawyers representing the State.

They also undertake to do the needful so that such mistakes which create hindrance in the peaceful functioning of the Court for administration of justice, are not caused by such panel lawyers.

While going through the affidavit, the Court found that no satisfactory explanation regarding conduct of the Government Advocate for giving such a statement as detailed in order dated 01.12.2022 and also about manner in which the counsels representing the State are functioning, has been given.

The Court allowed the prayer made for filing a better affidavit by Additional Advocate General, Government Advocate and Principal Secretary (L.R), in compliance with the order dated 01.12.2022.

The Court said that,

The Court has frequently faced such a situation where hindrance has been caused by counsels representing the State in proper administration of justice. Repeatedly, the aforesaid fact has been brought to the notice of the Government Advocate while sitting in criminal jurisdiction and to the Chief Standing Counsel while sitting in civil jurisdiction. The Court can always look into the qualitative performance of the counsels in the State panel and interfere in assessing their work and conduct, in case it creates hindrance in proper administration of justice and infringes fundamental rights of the persons, who have approached the Court for justice.

Keeping the aforesaid fact in mind and observations of the Court in the earlier orders, let Principal Secretary (Home), Principal Secretary (L.R) file a better affidavit by the next date fixed.

The Court has fixed the next hearing of the petition on December 16, 2022.
