The Allahabad High Court has said that five beneficiaries of the Kanshiram Awas Yojna allotment scam of providing houses to the urban poor and marginal sections of the society in Chandauli were arrested, but there is no information about the arrest of the officers working in the State, who were involved in the process of illegal allotments.
The Division Bench of Chief Justice Rajesh Bindal and Justice J.J Munir heard the PIL filed by Chandramohan Singh.
On December 19, an affidavit sworn by Ankur Agarwal, presently posted as Superintendent of Police, Chandauli, was filed in the Court.
It is a case in which FIR was registered way back in the year 2013 for the allegation regarding the illegal allotment of houses under the Kanshiram Awas Yojna which is meant for urban poor and marginal sections of the society.
The Court noted that,
What transpired at the time of hearing was that in the year 2013 the final report was also submitted, however, the same was not accepted by the court and since then the investigation is on.
Only five persons have been arrested till date and that too, only the beneficiaries and not the officers working in the State, who were involved in the process of illegal allotments.
It is claimed that sanction of prosecution against 11 Officers belonging to Revenue and other Departments has been sought from the State.
It could not be pointed out as to whether sanction is required even for arresting an accused in the FIR who may be government officer(s)/official(s).
The Court has fixed the next hearing of the petition on December 23, 2022.
