The Allahabad High Court on September 2 stayed the salary payment of Nand Kishore, CEO/Secretary of District Co-operative Bank Jhansi, till September 17.
A single-judge bench of Justice Prakash Padia passed this order while hearing a contempt application filed by Amlendra Nath Chaudhary.
The Contempt Petition has been preferred by the applicant against one Nand Kishore, Chief Executive Officer/Secretary District Cooperative Bank, Jhansi for noncompliance of the order dated February 26, 2020.
Against the aforesaid judgment though Special Appeal Defective was filed by the District CoOperative Bank Jhansi, the same was dismissed for non prosecution on March 15, 2021.
Counsel for the applicant argued that the order of punishment was passed against the applicant by the department order dated December 10, 2010.
Counsel for the applicant further argued that applicant has already been superannuated after obtaining the age of retirement in the year 2011 and at present he is about 70 years of age.
Counsel for the applicant said that in spite of the fact that the opposite party has full knowledge of the order passed by the Court, till date the same has been deliberately and wilfully not complied with. When the matter was taken up as fresh, counsel for the applicant was permitted to serve the notice upon Satyam Singh, Advocate order dated August 10, 2021.

On September 02, when the matter was taken up again a prayer was made by Satyam Singh, Counsel for the opposite party to grant some more time to comply with the order passed by the High Court.
The Court said, “It is unfortunate that in spite of the fact that writ petition filed by the applicant was allowed on February 26, 2020 i.e. more than about 18 months ago, till date the same has not been complied with. It is more unfortunate that today when the matter was taken up neither any instructions nor any affidavit of compliance has been placed by the opposite party before this Court. In the special facts and circumstances of the case as stated above, till the next date of listing no salary should be paid to the opposite party.”
The Court has fixed the next hearing of the petition on September 17, 2021.
