The Allahabad High Court has directed District Judge Bareilly to transfer the pending criminal case to the District Court of Ghaziabad and asked the District Judge, Ghaziabad to nominate it for hearing to a court having jurisdiction.
A Single Bench of Justice Anil Kumar Ojha passed this order while hearing a Transfer Application filed by Mahi Pal.
The Transfer Application has been filed with a prayer to transfer the Criminal Case under Sections 406/420/504/506 I.P.C from District Cantt Bareilly to District Court, Noida Gautam Budh Nagar.
During the course of arguments, counsel for the applicant and counsel for the opposite parties agreed to the fact that the case be transferred from District Court Bareilly to District Court, Ghaziabad.
Additional Government Advocate did not oppose the aforesaid prayer.
“Keeping in view the entire facts and circumstances of the case, I deem it appropriate to transfer the Criminal Case under Sections 406/420/504/506 I.P.C from District Court Bareilly to District Court, Ghaziabad to serve the ends of justice”, the Court observed while allowing the Transfer Application.
“District Judge Bareilly is directed to transmit record of aforesaid case to District Court, Ghaziabad within two weeks from the date of production of copy of this order. It is further directed to the District Judge, Ghaziabad to assign the aforesaid case to competent court having jurisdiction”, the Court ordered.
