Allahabad HC imposes Rs 10,000 cost on UP Board secretary for giving average marks to student

The Allahabad High Court has imposed a cost of Rs 10,000 on the Secretary of Uttar Pradesh Secondary Education Council (UP Board) Prayagraj for giving average marks by showing an absentee student in high school examination and harassing her unnecessarily.

This order has been given by Justice JJ Munir on the petition of Priyanka, a high school student.

In compliance with the earlier order, the Standing Counsel has produced the answer book of the petitioner relating to the High School Exam, 2020 in the subject of Social Science, where the petitioner was earlier declared to be absent. The script has been evaluated and an award has been made.

Earlier too, on the basis of the attendance records from the examination centre, the respondent Board had accepted the position that the petitioner did appear for the Social Science paper, but with the script not found, she was awarded average marks that were 26. The petitioner being a meritorious student had urged that her script be evaluated for its worth.

Sriprakash Singh, Standing Counsel, has stated that the Petitioner’s award of marks being undertaken, she has earned 52 marks on merits in Social Science, and 30 marks in the practical, aggregating a total of 82 marks, out of 100 in Social Science.

He has also placed before the Court written instructions that he has received from the Secretary, UP Board of High School and Intermediate Education through a memo dated 16.12.2020,
addressed to the Chief Standing Counsel. These instructions, apart from disclosing the fact indicated hereinabove, also encloses a xerox copy of the revised mark-sheet relating to the petitioner, based on her evaluated answer book in the subject of Social Science. This mark-sheet shows that the petitioner has been awarded a total of 82 marks in the relative subject.

The Court said the girl suffered mental harassment. For this, a cost of Rs 10,000 should be given to her. The sum has been directed to be deposited in a month in the bank account of the petitioner’s father Brijesh Kumar Singh through a demand draft.
