Calcutta High Court dismisses PIL challenging appointment of private respondent as the Chief Administrative Officer in State Council of Technical and Vocational Education

The Calcutta High Court dismissed a Public Interest Litigation (PIL) filed challenging  the appointment of the private respondent as the Chief Administrative Officer of the West Bengal State Council of Technical and Vocational Education and Skill Development.

The Petitioner challenged the same solely on the ground that the notification issued by the order of the Governor dated 23rd February, 2021 does not contain any notification number nor there is any mention about any approval granted by the Government of West Bengal. 

In this regard, the advocate  for the petitioner draw the attention of the Court to an earlier notification issued by the   Government of West Bengal dated 1st February, 2019.

The Division Bench of Chief Justice T. S. Sivagnanam and Justice Hiranmay Bhattacharyya is of the considered view that the grounds on which the petitioner seeks to challenge the notification dated 23rd February, 2021 issued by order of the Governor of the West Bengal is premature and the petitioner has not even approached the authorities nor secured any information before filing this writ petition as a public interest litigation.

“This Court is not here to collect information for the petitioner to substantiate his challenge to the impugned proceedings”, the Bench said while dismissing the PIL.
