CBI probe into West Bengal violence: SC asks state govt to file counter-affidavit

The bench of Justices Vineet Saran and Justice BR Gavai has directed the state of West Bengal and all other respondents to file their counter affidavit within three weeks.

The Supreme Court on Tuesday directed the West Bengal government to file its counter-affidavit on a plea seeking a CBI probe into the killings of two BJP workers in the post-poll violence in the state. 

The bench of Justices Vineet Saran and Justice B.R. Gavai directed the state of West Bengal and all other respondents to file their counter affidavit within three weeks. Appearing for the state of West Bengal, Senior Advocate Sidharth Luthra apprised the court of the FIR registered in this case and that three people have been arrested on the basis of these complaints. 

He also told the bench that a five-judge bench in the Calcutta High Court has been constituted to hear these issues. There are two five-judge benches before the Calcutta HC. One is doing this matter. And the other bench is hearing other matter which is item 36 today before this court. He further told the court the five-judge bench which was to hear the matter today couldn’t assemble due to the non-availability of the acting Chief Justice. 

The plea was filed by Biswajit Sarkar, the brother of deceased Bengal BJP worker Abhijit Sarkar, who was allegedly murdered when violence broke out after the Mamata Banerjee-led Trinamool Congress secured a convincing victory over the BJP in the 2021 Assembly elections.

His plea before the Supreme Court prayed for the formation of a Special Investigation Team by the Supreme Court so that the murder of Abhijit Sarkar and BJP booth worker, Haran Adhikari, can be inquired into. The apex court had issued notice in the plea last week.
