The Chhattisgarh High Court has disposed of a Public Interest Litigation (PIL) filed by the students, alleging that the medium of their examination changed suddenly.
The PIL was filed by the two students on the ground that they are the students of Government E.Raghavendra Rao Post Graduate Science College, which is affiliated to Atal Bihari Vajpayee Vishwavidyalaya and they got the admission while pursuing their medium as Hindi. It is stated that all of a sudden a notification dated 27.08.2022 has been issued wherein it shows that the medium of their examination would stand changed to English.
Sangharsh Pandey , counsel for the petitioners submitted that is against the provisions of Chhattisgarh Vishwavidyalaya Adhiniyam, 1973 (Adhiniyam of 1973) and clause 23 of the Adhiniyam of 1973 which mandates for the promotion and development of the study of Hindi, special measures would be taken by University/College or in co-operation with other Universities or the State Government or the Union Government. It is submitted that the Commissioner, Directorate of Higher Education unilaterally had issued a direction, though to take a decision of like nature with respect to medium of study in College or Universities is vested with the Academic Council which consist of different members, as per Section 25 of the Adhiniyam of 1973.
Consequently, it is stated even the Academic Council is required to act in accordance with the provisions of the Adhiniyam of 1973. The Counsel for the petitioners further submitted that the students have taken admission while pursuing their medium as Hindi and all of a sudden, their medium cannot be changed, as it otherwise would destroy the entire career of students and change of rule of game in midway .
On the earlier occasion, the respondents were directed to seek instructions. During the course of hearing, counsel appearing for the respondents placed a communication dated 15.12.2022, wherein it is stated that the college has notified that students may opt for Hindi or English medium and so the choice is left open to the students to appear in the examination either in English or Hindi medium.
In view of such submissions, counsel for the petitioners further submits that it is confined to a particular session.
Considering the above submissions made that both the mediums are open to students either to appear and give examination in Hindi or English, the grievance of the petitioners stand redressed , held by the Division Bench of Justice Goutam Bhaduri and Justice N.K. Chandravanshi.
