Faridabad Municipal Corporation to pay compensation to Khori Gaon dwellers: Supreme Court

The three member bench comprising of Justice AM Khanwilkar, Justice AS Oka and Justice CT Ravikumar ,ordered the Faridabad Municipal Corporation to compensate people allotted flats after they were evicted as part of Khori Gaon jhuggi demolition drive.

Senior Advocate Arun Bhardwaj, who appeared for the petitioners,informed the court the plight of the people who have been evicted.He mentioned,

They sleep under tarpaulin sheets and faced wrath of winter and will now face vagaries of summer. Municipal Corporation of Faridabad has to submit when will the flats be ready and what will be the deadline of final handover and what is the outer limit. We don’t want to be there without drinking water or drainage facilities

Counsel appearing on behalf of the Municipal corporation of Faridabad, Senior Advocate Arun Bhardwaj admitted the fact that the rehabilitation provided were not habitable.
Court observe that Basic readiness of the premises to occupy is lacking as of now. The basic facilities like water, sanitation, electricity should be there.

Advocate Bharadwaj appearing for the corporation submitted that the eligible persons, about 1027 will be alloted premises in habitable condition on a  permanent basis by end of April 2022.

The premises will be certified by the commissioner. Until the eligible persons  are given the possession of the flats, the corporation shall be liable to pay solatium amount of rs 2000 per month until the date of issuance of possession letter. Which will only be after the certification of the premises as habitable by the commissioner.
The process of allotment is to be completed by the corporation before 21st April.

It was brought to the notice of this court that the plot from which the unauthorized structures were removed is being misused by the locals. Therefore the court directed the Superintendent of police, Faridabad to provide necessary assistance to the corporation to ensure that no misutilization or encroachment of the plot/area takes place in future and take action. In addition as the  corporation is already working on a plan for the redevelopment of the entire area, the secy of forest department may issue appropriate directions to facilitate plantation of appropriate species of trees in the area

The court has also asked the State authorities to provide provisional accommodation to those evicted until the new housing facility for them is ready.The next date of the hearing is 26th April
