Delhi LG-Municipal Corporation Spat Goes to Court

Campaign for People Participation in Development Planning has moved the Delhi High Court against a notification by the Lieutenant Governor of Delhi for a construction. The notification, the organization claims, is ultra vires.

The reason for this move before the bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar is because the organization feels that issuing such instructions is not the authority of the LG, but of the municipal corporation, according to section 507 of the Municipal Corporation Act, 1957.

The organization contends that in 1994 a notification was issued that all areas of Delhi will be treated as urban area. The petitioners ask that in that case, what is the purpose of this latest notification which relates to conversion of rural areas into urban areas.

As per the LG’s notification, they want to construct 20-storey buildings in those “rural” areas.

The court ordered the respondents to file affidavit and the next hearing is on October 25.
